During the 8th moon of the 10th year of the Republic of China, did at Shanghai, conspire together with his deceased father with a malicious purpose to forge a fangtan which he then sold to the Complainant, M. Aski. Contrary to Art.383 of the C.P.C. Code.
Dr. Fischer appeared for the Compt. and said: The Japanese
Assessor issued the warrant on Saturday last. We allege that in September last the accused forged the fangtan, D. S.Robertson served
the warrant on the accused and he produced a certificate showing
that he was registered at the Spanish Consulate. There is not the slightest doubt that the accused tried to escape the jurisdiction
of this Court. The subject matter of this case happened before
the accused was registered and I ask the Court to remand the case
for the Japanese Assessor,
Assessor said: These certificates are valueless, the Court
will take jurisdiction in this case, in all these cases the
accused must prove that they have ceased to be Chinese citizens.
Decision: Remand till tomorrow for the Japanese Assessor.
Accused is a Chinese citizen, and therefore subject to the juris-
diction of this Court.
